Subway is being sued for "short selling everyone of their footlong sandwich".
Two New Jersey men are suing Subway because their footlongs are not actualy a foot long. They filed on Tuesday in Superior Court in Mount Holly. This suit is possibley the first legal filing against Subway shops after a photo went viral. Someone posted a picture of a footlong sandwich lined up with a ruler on Subways Facebook page. The picture showed that the sandwich was not a footlong as advertised on television. When the suit was filed, "the company issued a statement saying that the sandwich length can vary a bit when franchises do not bake to the exact corporate standards."
Stephen DeNittis, the lawyer for the case, said he is preparing to file a similar suit in Pennsylvania state court in Philadelphia. He said he's had sandwiches from 17 different shops, and everyone has failed to meet a foot long. "The case is about holding companies to deliver what they've promised." Stephen said. Even though the bread is short of a half-inch, it adds up, said Stephen.
Subway has 38,000 shops around the world, and its 5$ footlong specials have been around in the company's ads for five years. DeNittis said both clients, John Farley, of Evesham and Charles Noah Pendrack, came to him after reading last week about the short sandwiches. DeNittis is asking for compensatory damages for his client and a change in Subway's practices. The Milford firm conclued that Subway should either make sure its sandwiches measure a full foot or stop advertising them as such.
I don't think suiing is the way to go, but this article really shows how people will believe anything the media tells us. I mean, have any of you ever questioned if a footlong was really a foot? Not me, I just assumed it was.
I think it's a bad decision to sue Subway. When you go to subway, obviously every single sandwich is not going to be exactly 12 inches. I'm sure every Subway store you go will have varying lengths. Personally, I think getting a footlong for $5 is good enough, because you can't usually get that price anywhere else. If anything, I think those two men should sue the specific store they went to, not the whole entire company.
ReplyDeleteI personally believe that this case is a terrible idea. Because I is absolutely impossible for every sandwich to be exactly a foot long. And really if it is off by a half inch does it really matter? I mean you still got a pretty big sandwich. Plus how much money are you going to get for suing them? The hole $5 you paid for the sandwich? Because that isn't exactly going to cover all the court costs that you are going to have. I just think that they are taking the situation to an unnecessary level.
ReplyDeleteI agree with you guys. This whole thing is stupid and they won't win. Yes I would like it to be a bit longer but I'm happy what i get now. Subway did the foot long campaign because it was catchy. Not every sandwich is going to be a foot long. I don't get why they would do something this stupid. There has to be more to this then just it not being a foot long. Well if anyone knows comment below.
ReplyDeleteI think it's harsh to sue subway. Like Taylor Smith said, don't sue the whole company. You can just sue the one store. I think getting a foot long for $5.00 is a really good price.
ReplyDeleteOk I guess I could say that the footlongs are truly not a foot long, but why would people make that big of deal about it anyways? It's a five dollar sandwich.. not some really expensive thing that truly has an impact on your life. I'm sure that these kids are probably just people looking for anyway to find money. And I can almost guarantee that they knew that the subs weren't twelve inches long way before they decided to point it out and start something not worth being started. Subway probably picked the slogan footlong because it was catchy, it's dang close to a foot if you ask me.
ReplyDeleteI've never questioned if Subway subs were actually a footlong. I've always assumed they were a footlong too. I love Subway and a half of an inch isn't a bit deal to me. I honestly think suing is going a bit too far. I don't think $5 is too much to pay for a footlong sandwich, and I can't eat a whole footlong by myself. These people probably just want attention, and they're making a big deal out of it. I wonder if Subway knew their subs were half an inch short...?
ReplyDeleteObviously not every sub they make will be a footlong. The people that filed to sue Subway have to realize that. To me the people who filed to sue Subway are unreasonable. Not everything can be perfect and i bet sometimes the subs are over a foot. Wouldn't you agree?
ReplyDeleteI think it is dumb to sue the whole company. I mean even if the sandwich is a little shorter than a foot long it is only $5. You aren't always going to have the same size sandwich. Even if they are a few inches short they are very fulling. I think this whole thing is dumb.
ReplyDeleteI think that the whole thing about these two people is a joke. If they weren't happy with there sandwich then they should of complained to the people working at the Subway. For 5 dollars it is a bit much when you can make one at home. If these people aren't happy with Subways sandwich cause it is not 12 inches then just don't go there. I think that these people's just wanted to get on TV is all and make a little publicity scene.
ReplyDeleteI never even thought to check to see if my sub was acctually a foot long. They should relize that the bread won't come out to be exactly twelve inches long every time. I don't think it's a big enough deal to sue Subway. Plus, if it was only a $5 one would it really be worth it? I think that they need to relize that the subs aren't always going to be exactly a foot long and they can choose to whether or not they want to eat at Subway.
ReplyDeleteSince I work at Subway and know how everything is done, Subway should not be being sued for the sandwhiches not being a footlong. It all depends on how you cook it and put it in the bread pans. I think this is a stupid thing to do because not all Subways are like that.
ReplyDeleteI had heard of this on the news not that long ago. I personally think that they are ridiculous for suing Subway. I don't mind the extra inch difference. To me food is food. It doesn't matter if its three inches or six inches or even a foot, people are going to eat it if they are hungry amd I bet they will enjoy it. I don't think they would win anyway because Subway is such a big corporation that they probably have really good lawyers. Do you think they could win in the lawsuit?
